CHARTER ORDINANCE NO. 48

 

A CHARTER ORDINANCE of the City of mcpherson, kansas, amending section 1 of charter ordinance no. 44, which EXEMPTs the CITY OF MCPHERSON, KANSAS FROM THE PROVISIONS OF K.S.A. 14-1308, AND AMENDMENTS THERETO, AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS RELATING TO MEETINGS OF the BOARD OF COMMISSIONERS AND APPROVAL AUTHORITY BETWEEN MEETINGS.

 

WHEREAS, the governing body of the City has heretofore passed Charter Ordinance No 44 which exempts the City from the provisions of K.S.A 14-1308, and amendments thereto; and

 

WHEREAS, the governing body of the City desires, by Charter Ordinance, to amend Section 1 of Charter Ordinance No. 44.

 

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MCPHERSON, KANSAS:

Section 1.  The City of McPherson, Kansas (“City”), by virtue of the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to exempt itself and hereby makes inapplicable to is Section 14-1308, and amendments thereto, Kansas Statutes Annotated, which apply to said City as they relate to meetings of the Board of Commissioners and approval authority between meetings, and the City provides further substitute and additional provisions as set forth herein.

            Meetings of board; quorum. Said board of commissioners shall meet at least twice every month in regular meeting in the city hall, at such times as shall be fixed by said board of commissioners, and take under advisement and act upon such business as may come down before them. The majority of said board shall constitute a quorum for the transaction of business. The governing body may elect at a prior public meeting to skip up to four (4) regular meetings per calendar year as long as no two consecutive meetings are skipped. For any month in which the board of commissioners does not meet, the City Administrator with the concurrence of the City Treasurer may authorize and pay any obligation of the City provided that the same is reported to the board of commissioners at the next meeting thereof.

Section 2.  Same; powers supplemental and additional. The powers granted herein shall not be construed to limit the City’s authority under the provisions of any other laws.

Section 3.  Further Actions.  Nothing contained within this Charter Ordinance shall prohibit the governing body from exercising authority granted hereunder by the adoption of simple ordinances enacted after the date hereof.

Section 4. Publication.  This Charter Ordinance shall be published once a week for two (2) consecutive weeks in the official City newspaper.

Section 5. This is a Charter Ordinance and shall take effect sixty-one (61) days after final publication, unless a sufficient petition for a referendum is filed requiring a referendum to be held on this ordinance as provided in Article 12, Section 5, subdivision (c)(3) of the Constitution of the State of Kansas in which case this Ordinance shall only become effective on the first day of the month following approval by a majority of the electors voting thereon.
